Terms of use
These terms cover how you may use this website and what an offer request does and does not mean. Requesting an offer never obligates you to sell; only a signed purchase agreement does.
The short version
Requesting an offer is free and non-binding. You are never obligated to sell, and we are not obligated to buy, until both sides sign a written purchase agreement.
Offers are preliminary until we have seen the property and reviewed title. The offer we write after that is the offer we close on.
We are a buyer, not a broker, and nothing on this site is legal, tax or financial advice.
Use the site honestly, give us accurate information, and don't scrape or misuse it.
The rest of this page is the full agreement. It is written to be understood, and we would rather you read it than click past it.
Agreeing to these terms
By visiting pomonahomebuyer.com (the "Site") or submitting the offer form, you agree to these Terms of Use and to our Privacy Policy, which explains how we handle the information you give us. If you do not agree, please do not use the Site.
You must be at least 18 years old and able to enter into a binding agreement to use the Site. If you submit information on behalf of someone else, such as an estate, a trust, a family member or a client, you confirm you have their authority to do so.
Who we are
Pomona Home Buyer (Pomona Home Buyer , "we," "us") is a real estate investment company based in Pomona, California. We purchase residential property directly, with our own funds or funds we arrange, for our own portfolio or resale.
We are not a licensed real estate brokerage, and we do not act as your agent, list your property, or represent your interests in a transaction. When you accept our offer, we are the buyer and you are the seller, and each of us is free to hire our own representatives. We are a service-area business; we meet you at the property or by video, and we do not maintain a public office.
Offer requests and offers
Submitting the form
The offer form is a request for us to evaluate your property. Submitting it does not create a contract, does not commit you to sell, and does not commit us to make an offer. We may decline to make an offer for any lawful reason, including property type, location, condition, title issues or market conditions, and we will tell you if we do.
What an offer is
Any price we quote, whether by email, text, phone, video call or in writing, is a preliminary, non-binding indication until we have:
- Completed a walkthrough of the property, in person or by video, and
- Reviewed title, liens, occupancy and any court, lender or HOA requirements that affect the sale.
After that review, we issue a written offer. Once both sides sign a written purchase agreement through a licensed California escrow, that agreement, and not these terms, governs the sale. If anything in a purchase agreement conflicts with these terms, the purchase agreement controls.
How offers are priced
Our offers reflect what we believe we can resell or hold the property for after repairs, less repair costs, holding and transaction costs, and a margin for the risk we take on. That is usually less than a list price a real estate agent might quote. We disclose how we arrived at the number, and you are free to compare our offer to any other option. Descriptions on the Site such as "fair," "as-is," "no fees" and "close in as few as 7 days" describe how we generally operate; actual timing depends on title, escrow, occupancy and any required court or lender approvals.
No guarantee of value or timing
Nothing on the Site is a promise of a particular price, a particular closing date, or that we will purchase your property at all. Market statistics, neighborhood descriptions and examples on the Site are general information and may be out of date.
Not professional advice
Nothing on this Site, and nothing we say in the course of evaluating your property, is legal, tax, financial, lending or real estate brokerage advice. Selling a home, especially one in probate, foreclosure, a divorce, a trust or with tenants, can have legal and tax consequences. Please consult a qualified attorney, CPA or licensed professional before making decisions.
Where we describe California or Los Angeles County procedures, such as probate, foreclosure timelines or tenant rules, we do so to help you understand the general process. Laws and local rules change, and we may simplify them. We are not responsible for decisions made in reliance on that information.
Information you submit
When you submit the form or send us details, photos or documents, you confirm that:
- The information is accurate and complete to the best of your knowledge, and you will let us know if it changes;
- You own the property, or have the legal authority (for example as an executor, trustee, attorney-in-fact or authorized agent) to discuss its sale; and
- You have the right to share any photos or documents you send us.
You keep ownership of what you send. You give us permission to use it to evaluate the property, communicate with you and, if we buy the property, to complete the transaction. We handle it as described in our Privacy Policy. We do not sell your information or pass your request to other buyers, wholesalers or agents.
Communications
By submitting the form with your email address and mobile number, you agree that we may contact you about your property and your request by email, text message (SMS/MMS) and phone, including with automated technology. Message and data rates may apply. Reply STOP to any text to end texts, or tell us in writing to stop any type of contact, and we will. Agreeing to texts or calls is not a condition of receiving an offer; you may ask us to communicate by email only.
We may also send you transactional messages that are part of the process, such as scheduling confirmations, document requests and escrow updates.
Acceptable use
You may use the Site for its intended purpose: learning about selling a home to us and requesting an offer. You agree not to:
- Submit false, misleading or fraudulent information, or requests for properties you have no authority over;
- Use the Site or the form to send spam, solicitations, or marketing for another business, including other home buyers, agents or lead services;
- Scrape, crawl, copy or harvest content, code or data from the Site by automated means, except as search engines do to index it;
- Interfere with the Site's security or operation, probe for vulnerabilities, or attempt to access accounts, systems or data you are not authorized to access;
- Impersonate us, a member of our team, or another person; or
- Use the Site in any way that violates the law.
We may block access, discard submissions, or decline to work with anyone who violates these rules.
Content and trademarks
The Site's text, design, code, graphics and photographs are owned by us or used with permission and are protected by copyright and other laws. "Pomona Home Buyer" and the Site's look and feel are our trademarks and trade dress. You may view and print pages for your personal use in deciding whether to sell to us. You may not otherwise copy, republish, modify or create derivative works from the Site without our written permission.
Third-party services
The Site uses third-party services to host pages, run the offer form, send email and texts, and measure traffic. Those services are subject to their own terms. The Site may also link to outside resources such as county records, Google Maps, or a title company; we do not control those sites and are not responsible for their content or practices.
Disclaimers
The Site and everything on it are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses, or that any information on it is complete or current.
Some states do not allow certain warranty disclaimers, so parts of this section may not apply to you.
Limitation of liability
To the fullest extent permitted by law, we and our owners, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost opportunities, or lost data, arising from your use of the Site, your reliance on its content, or any offer or non-offer we make, even if we have been advised of the possibility of such damages.
Our total liability for any claim relating to the Site or these terms will not exceed one hundred dollars ($100). This limit does not apply to obligations under a signed purchase agreement, which are governed by that agreement.
Some states do not allow limits on certain damages, so these limits may not apply to you in full. Nothing here limits liability that cannot be limited under California law.
Indemnification
You agree to defend and hold us harmless from claims, losses and reasonable attorneys' fees arising from information you submit that is false or that you had no authority to submit, from your violation of these terms, or from your violation of anyone else's rights or the law in connection with the Site.
Governing law and disputes
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute about the Site or these terms will be brought in the state or federal courts located in Los Angeles County, California, and you agree to that venue and jurisdiction. Claims that qualify may be brought in small claims court instead.
Before filing anything, please contact us using the details below. Most issues are misunderstandings, and we will try to resolve them within 30 days. Disputes about a signed purchase agreement are handled as that agreement provides.
General terms
- Changes. We may update these terms from time to time. The effective date at the top shows the current version, and continued use of the Site after a change means you accept it. Changes do not affect a purchase agreement already signed.
- Entire agreement. These terms and the Privacy Policy are the whole agreement between you and us about the Site. A signed purchase agreement is a separate agreement that governs the sale of a property.
- Severability. If any part of these terms is found unenforceable, the rest remains in effect.
- No waiver. If we do not enforce a provision, we may still enforce it later.
- Assignment. You may not transfer your rights under these terms. We may assign them to a successor business.
- Fair housing. We buy property without regard to race, color, religion, sex, disability, familial status, national origin, or any other characteristic protected under federal or California fair housing law.
